No, you cannot get by herpes from sharing a hot tub with someone who has herpes, however the infection can be transmitted by sexual contact whilst in a hot tub.
Keep in mind, the herpes virus is very fragile and highly sensitive to environmental conditions. As such, it cannot survive for long periods of time outside the body such as in treated water.
